Terms and Conditions

Effective date: 24 October 2026

These Terms and Conditions (“Terms”) govern your access to and use of the DCustomThreads website, online design tools, customer accounts, online stores, products, and services. In these Terms, “DCustomThreads,” “we,” “us,” and “our” refer to DCustomThreads, located in Toronto, Ontario, Canada. “You” and “your” refer to the website visitor, customer, account holder, or store applicant.

By using this website, creating an account, submitting a store application, approving artwork, or placing an order, you agree to these Terms. If you do not agree, do not use the website or submit an order. Nothing in these Terms limits rights that cannot lawfully be waived under applicable consumer protection law.

1. Our Products and Services

DCustomThreads provides custom embroidery, direct-to-film (DTF) printing, direct-to-garment (DTG) printing, and related custom apparel services. Products may include t-shirts, hoodies and sweatshirts, polos, hats and headwear, jackets, workwear, bags and totes, aprons, and other items shown on the website.

Product availability, colours, sizes, brands, materials, decoration methods, prices, and production timelines may change. We may recommend a substitute when a selected item is unavailable, but we will not make a material substitution without your approval.

2. Accounts and Website Use

You must provide accurate, current information when creating an account or placing an order. You are responsible for keeping your login credentials confidential and for activity under your account. Notify us promptly if you believe your account has been accessed without authorization.

You may not misuse the website, interfere with its operation, attempt unauthorized access, upload malicious code, use automated tools in a way that burdens the service, or use the website for unlawful, fraudulent, or abusive purposes.

3. Designs, Artwork, and Customer Content

You retain ownership of artwork, logos, text, photographs, and other content you submit (“Customer Content”). By submitting Customer Content, you grant DCustomThreads a limited, non-exclusive licence to store, reproduce, modify for production, display in proofs, and use that content only as reasonably necessary to quote, prepare, produce, fulfil, support, and document your order.

You represent that you own the Customer Content or have permission to use and reproduce it. You are responsible for obtaining any required copyright, trademark, publicity, privacy, or other permissions. We may refuse content that we reasonably believe is unlawful, infringing, hateful, defamatory, deceptive, threatening, or otherwise inappropriate.

Low-resolution artwork, fine detail, gradients, small text, colour conversions, garment texture, thread limitations, and screen display differences can affect the finished result. We may adjust artwork for production and will identify material changes through a proof or approval process where applicable.

4. Quotes, Pricing, and Taxes

Quotes are based on the information available when issued, including product, size range, quantity, decoration method, artwork complexity, stitch count, print locations, turnaround, and delivery requirements. A quote may change if those details change or if supplier pricing or availability changes before the order is accepted.

Prices are shown in Canadian dollars unless stated otherwise. Applicable taxes, shipping, rush charges, artwork preparation, digitizing, setup charges, oversized garment charges, and other fees will be disclosed before checkout or confirmed in the written quote. Obvious pricing or typographical errors may be corrected before production begins. If a correction materially changes your total, we will request approval before proceeding.

5. Order Review and Acceptance

Before submitting an online order, you will have an opportunity to review and correct relevant order details. Your order is an offer to purchase and is subject to acceptance, payment authorization, product availability, and artwork review. An automated acknowledgement does not necessarily mean that production has begun.

We may decline or cancel an order before production for reasons such as unavailable products, unsupported artwork, suspected fraud, pricing errors, technical issues, or content that violates these Terms. If we cancel an accepted paid order before production, we will refund the amount paid for the cancelled portion.

6. Proofs and Customer Approval

Where a proof is provided, you are responsible for reviewing spelling, names, dates, colours, placement, size, quantities, garment details, and all other visible information. Production may begin after your approval. Delays in approval may delay the estimated completion date.

Your approval confirms that the proof is acceptable for production, subject to reasonable variations inherent in embroidery and printing. DCustomThreads is not responsible for errors that appeared in an approved proof unless the finished product materially differs from that approved proof.

7. Production Times and Rush Orders

Production and delivery dates are estimates unless DCustomThreads expressly confirms a guaranteed date in writing. Timing begins only after all required information, artwork, approvals, and payments have been received. Product availability, order changes, approval delays, equipment issues, carriers, weather, and events beyond reasonable control may affect timing.

Rush service may be available for an additional fee and must be confirmed before ordering. Purchasing expedited shipping does not necessarily shorten production time.

8. Custom-Made Goods, Changes, and Cancellations

Because decorated apparel is made to your specifications, changes or cancellations may not be possible after artwork approval, product ordering, digitizing, printing, embroidery, or other production work has begun. Contact us immediately if you need a change. If we can accommodate it, additional costs and a revised timeline may apply.

Any cancellation or refund policy will be applied subject to mandatory rights available under applicable law. This section does not remove any right that cannot legally be excluded.

9. Shipping, Delivery, and Pickup

Shipping options, costs, and available destinations are displayed at checkout or confirmed in your quote. You are responsible for providing a complete and accurate delivery address. Carrier transit times are estimates, and carrier delays may occur after an order leaves our control.

Inspect your package promptly. Report missing, damaged, or incorrect items within [confirm reporting period, recommended: 7 days] of delivery and include the order number and clear photographs where relevant. Do not use, wash, or alter an item you believe is defective or incorrect before contacting us.

If pickup is offered, wait for confirmation that the order is ready and follow the supplied pickup instructions.

10. Returns, Defects, and Reprints

Custom-decorated and personalized products generally cannot be returned or exchanged because of a change of mind, an incorrectly selected size, or an error in Customer Content or an approved proof. This does not affect remedies required by law.

If DCustomThreads makes a production error, supplies an incorrect item, or delivers a product with a verified manufacturing or decoration defect, contact us within the reporting period. After review, an appropriate remedy may include correction, replacement, reprint, store credit, or refund for the affected item. We may ask you to retain or return the item while the issue is assessed.

Minor variations in colour, placement, thread, dimensions, fabric, and appearance may occur between screens, proofs, samples, production methods, garment batches, and individual items. A reasonable industry variation is not necessarily a defect.

11. Sizing and Product Information

Size charts and product information are provided by manufacturers and suppliers. Measurements and colours may vary between brands, styles, and production batches. Review the applicable size chart before ordering. Unless the product is defective or incorrect, personalized items ordered in the wrong size are not generally eligible for exchange.

12. Customer-Supplied Items

If DCustomThreads agrees to decorate customer-supplied garments or goods, those items are provided at the customer’s risk. Some materials, coatings, seams, wear, or hidden defects may react unpredictably to heat, pressure, needles, ink, or handling. Any responsibility for accidental damage to customer-supplied items will be determined under the written quote and applicable law. [Confirm whether customer-supplied items are accepted and add the actual replacement-value policy.]

13. Online Stores

Online store applications are subject to review and approval. Store availability, products, pricing, branding, access, ordering periods, fulfilment, proceeds, fundraising amounts, minimums, and closure rules will be set out in the applicable store arrangement. DCustomThreads may suspend or close a store for security, inactivity, unlawful content, policy violations, or operational reasons, subject to any written store agreement.

Store owners must have permission to use all names, logos, and artwork supplied for the store and must not make promises to purchasers that conflict with information approved by DCustomThreads.

14. Payments and Chargebacks

Available payment methods are shown at checkout or on the invoice. You authorize us and our payment processor to charge the approved total. If you believe a charge is incorrect, contact us first so we can investigate. Fraudulent or abusive chargebacks may result in account restrictions or lawful collection activity.

15. Intellectual Property

The website, DCustomThreads name and branding, layout, original text, graphics, photographs, and other materials owned by DCustomThreads are protected by applicable intellectual property laws. Except as permitted by law, you may not copy, republish, sell, reverse engineer, or commercially exploit them without written permission.

16. Third-Party Services and Links

The website may rely on third parties for hosting, payments, analytics, shipping, product supply, design tools, social media, and other services. Third-party sites and services are governed by their own terms and privacy practices. DCustomThreads is not responsible for unrelated third-party content or services it does not control.

17. Disclaimers and Limitation of Liability

To the extent permitted by law, the website and its content are provided on an “as available” basis. We do not promise that the website will always be uninterrupted, error-free, or free of harmful components.

To the extent permitted by law, DCustomThreads will not be liable for indirect, incidental, special, exemplary, or consequential loss arising from website use or an order. Any aggregate liability relating to a specific order will not exceed the amount paid for the affected goods or services. These limitations do not apply where prohibited by law and do not limit mandatory consumer rights.

18. Indemnity

To the extent permitted by law, you agree to indemnify DCustomThreads against third-party claims, losses, and reasonable costs arising from Customer Content that infringes another person’s rights, your unlawful use of the website, or your material breach of these Terms.

19. Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without limiting any mandatory consumer protection rights that apply based on your location. Any dispute may be brought before a court of competent jurisdiction in Ontario unless applicable law requires otherwise.

20. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted with a new effective date. Changes apply prospectively unless the law permits otherwise. Terms applicable to an accepted order will not be materially changed after the fact without agreement or lawful authority.
